1. DEFINITIONS & LAW
1.1 This contract is the document or documents that set out all terms and conditions and all other details about your agreement with ourselves.
1.2 We shall not be bound by any terms and conditions you may have put forward unless we have specifically in writing agreed to your terms and conditions.
1.3 These terms and conditions will apply to whichever particular contract you have agreed to enter into with ourselves. The terms and conditions will not be applicable to yourselves.
1.4 The Principal: Camera Support Services Ltd of Skyline Studio's, Elm Bank Farm, High Oak Heightington, Worcestershire, DY12 2YP.
1.5 The Customer: means the person, firm or company who or which have agreed to enter into the contract with the Principal.
1.6 No representations made by the Principal (except in writing) or its employee will have the affect of altering the terms and conditions of this agreement.
1.7 Payment is to be on the payment date given to the customer and interest shall accrue at the rate of 6% per annum on any overdue payments.
1.8 Time of delivery for performance of the agreement by the Principal shall not be "time of the essence".
1.9 No waiver by the Principal of any breach by the customer shall be construed as a continuing waiver.
2. TERMS & CONDITIONS FOR EQUIPMENT HIRE
2.1 The principal agrees to hire the equipment as detailed in this agreement for the hire period as detailed in this agreement at the rental as detailed within this agreement.
2.2 The hiring of the equipment will commence on the date on which the equipment is delivered to or made available for the collection by the principal.
2.2a The Customer will before the hire commencement be required to pay a Holding Deposit based on a percentage of replacing the equipment. THIS DEPOSIT (Less any damage or loss costs) WILL BE REFUNDED TO THE CUSTOMER UPON SAFE AND PROPER RETURN OF THE EQUIPMENT.
2.2b A charge will be made to the Customer for any undue loss or damage caused to the equipment whether in use or in transit whilst on hire.
2.2c The customer shall be totally responsible for the safe and proper use of the equipment at all times.
2.3 Responsibility and obligations of the Customer.
2.3.1 The Customer is responsible for the safe keeping of the equipment, protection against the elements, theft, vandalism and improper use and shall make good any damage or loss to equipment which may occur for any reason whatsoever to the principal.
2.3.2 The Customer will at all times and in all respects indemnify the principal against and from any and every expense liability financial loss claim or proceedings whatsoever and in respect of any personal injury whatsoever or damage or loss of any property whatsoever arising out of or in connection with or consequent upon delivery, use, non-use, repossession, collection, return or non-return of the equipment or any part thereof.
2.4.1 The equipment shall at all times remain in the ownership of the principal and the customer will have no rights in the equipment other than as bailee. The equipment must only be used by the customer and the customer shall not sell, assign, charge or create any sub-lease or license over or otherwise dispose of or abandon the equipment.
2.5.1 The customer has selected the equipment using his own skill and judgement and shall have no claim whatsoever against the principal for the wrongful selection of the equipment or for the wrongful use of the equipment.
2.5.2 No liability shall attach to the principal for any representations made by or on behalf of the manufacturer of the equipment.
2.6 Obligations of the Customer
2.6.1 The customer accepts full responsibility for the care and safe keeping and return in good order of the equipment.
2.6.2 The customer will pay to the supplier all costs incurred by the principal in rectifying the condition of any equipment returned damaged or unclean.
2.6.3 The customer will also be responsible for any losses suffered by the principal as a result of the equipment not being usable, until the equipment is either repaired or replaced by the principal.
2.6.4 In the case of equipment which is lost, stolen or damaged beyond economic repair the customer will in all cases meet the full cost of replacing the equipment.
2.7 Usage of equipment
2.7.1 The customer shall use the equipment in accordance with any guidance and conditions either supplied by the principal or by the manufacturer.
2.7.2 The customer shall not modify or make any alterations or make any repairs to the equipment.
2.7.3 If the equipment is not returned by the said return date the customer will be liable for full payment of hiring of the equipment together with any further losses incurred by the principal.
2.7.4 The customer undertakes at all times to take good care of the equipment as though it belongs to the customer and to observe the terms and conditions of any insurance arranged by the principal in respect of the hired equipment.
2.7.5 The customer shall not hire out the equipment to any other party without the written consent of the principal and whenever this is given the subsequent customer shall be bound by the terms of the contract as though he was the original customer and observe and fulfil all of its obligations.
